CNN —Judge Aileen Cannon has indefinitely postponed former President Donald Trump’s classified documents trial in Florida, citing significant issues around classified evidence that would need to be worked out before the federal criminal case goes to a jury. In an order Tuesday, Cannon cancelled the May trial date and did not set a new date. By indefinitely postponing the classified documents trial, Cannon’s order pushes it closer to the 2024 election – and potentially afterward. But, Cannon said, witness statements can be used in the public filings — unless those statements would be identifying. Smith had strongly pushed back on a previous order from Cannon for transparency surrounding the identification of witnesses, pointing to fears of witness harassment. The ethics charges that were brought against Clark by the DC Bar’s Office of Disciplinary Counsel allege that he was dishonest and attempted to interfere with the administration of justice after the 2020 election. CNN —An attorney discipline judge in California has recommended that ex-Trump election lawyer John Eastman be disbarred, according to an opinion released on Wednesday. Judge Yvette Roland’s opinion comes after a lengthy trial about Eastman’s actions as he led some of the efforts for Donald Trump to challenge his 2020 election loss. The opinion serves as a recommendation to the California Supreme Court, which will ultimately decide whether to endorse or reject the punishment. In the ballot litigation, Trump is appealing a decision from the Colorado Supreme Court in December that he incited the attack on the US Capitol as electoral votes were being counted in 2021. Arguments at the US Supreme Court last week focused less on whether there was an insurrection and more on technical questions about whether states may enforce the ban. A political fight over eligibility would likely be limited to Congress, but it could sweep the Supreme Court back into the thicket, as well. “Depending on just how horrendously ugly the situation could get, the court might feel compelled to become involved,” Foley said.

Possible witnesses against Trump are “routinely” being threatened in a way that could intimidate them from participating in the case, they added. Trump’s lawyers have sought to make public the witness names and related information in the case, since they have included them in court filings. “Their objective is plain—to delay trial as long as possible,” prosecutors wrote in a filing Thursday in the case.

CNN —Most Americans want to see a verdict on the federal charges former President Donald Trump faces related to election subversion in 2020 before this year’s presidential election, according to a new CNN poll conducted by SSRS. About half of Americans, 48%, say it’s essential that a verdict is reached before the 2024 presidential election, and another 16% that they’d prefer to see one. Trump currently faces four separate criminal indictments, including federal charges related to his alleged efforts to overturn the results of the 2020 presidential election. Among those who see a pre-election verdict in the federal Trump election subversion case as essential, just 35% express trust in the Supreme Court on election-related cases. Washington CNN —Special counsel Jack Smith’s office is defending how the federal government during Joe Biden’s presidency sought to repossess White House records Donald Trump took, and how the case evolved into a federal investigation. The prosecutors say Trump’s legal team has attempted to distort the events in his favor – including by claiming he had a security clearance that extended past his presidency. But the prosecutors on Friday wrote Trump’s team “not only knew” of the Biden White House being part of the discussion, they also approved of it. On Friday, the special counsel’s office argued the case’s evolution followed Justice Department protocol, including in how White House employees spoke with DOJ officials. According to the filing, there has not been any communication between prosecutors and Biden or senior White House political officials either about the investigation or otherwise.

Washington CNN —The Washington, DC, trial date in the federal election subversion case against former President Donald Trump has been postponed because of ongoing appeals about the power of the presidency, according to a new court order in the case. Though not official until US District Judge Tanya Chutkan’s order Friday, it became increasingly less likely that the March trial date would hold. The federal case against Trump had been set to begin first among the criminal indictments he faces. The Mar-a-Lago documents case judge, Aileen Cannon, a Trump appointee in south Florida, has left open the possibility of revisiting the trial schedule at a hearing March 1. The state-level judge presiding over Trump’s 2020 election conspiracy in Georgia has yet to set a trial date.

CNN —The federal appeals court in Washington, DC, declined to rehear arguments over whether former President Donald Trump can be prohibited from talking about witnesses and court staff while he awaits trial in the special counsel’s January 6 criminal case. Trump has unsuccessfully tried to challenge the gag order placed on him by Judge Tanya Chutkan late last year through appeals. The 11 judges from the DC Circuit Court of Appeals on Tuesday declined to touch the case after a three-judge panel previously upheld the gag order against Trump. Trump can appeal the ruling to the Supreme Court, and his attorneys have previously indicated that they would appeal the matter to the nation’s highest court if necessary. But the court said the gag order does not apply to comments made about special counsel Jack Smith and narrowed the prohibition Trump had regarding speaking about witnesses in the case, a change from the original gag order.

CNN —The inmate accused of attacking Derek Chauvin, the former police officer convicted in George Floyd’s killing, stabbed him approximately 22 times with an improvised knife in an attack the Arizona inmate had been contemplating for around a month, according to court documents. Turscak, who has been charged with attempted murder, told the corrections officers he would have killed Chauvin had they not responded so quickly, according to the complaint. Turscak has been charged with three other counts, including assault with intent to commit murder, assault with a dangerous weapon and assault resulting in serious bodily injury. “Why was Derek allowed into the law library without a guard in close enough proximity to stop a possible attack? He was convicted in April 2021 on state charges of second-degree unintentional murder, third-degree murder and second-degree manslaughter.
